Daybreak Studio — Terms of Service

Daybreak Studio ("we", "us") is the trading name of Calum McMahon, a sole trader based in Essex, England. These terms apply when you buy a website build or monthly care plan from us. By paying, you agree to them. Our services are supplied to businesses for business purposes.

1. What you get with the build (£249 one-off)

A single website for your business: your services, service area, contact details, reviews, and photos, built mobile-first and connected to a domain name. We aim to make it live within 72 hours of receiving your content (photos, preferred contact details, and confirmation of your services). Delays in sending us content extend that timeline accordingly.

2. What you get with the care plan (£29/month)

Hosting, security and technical upkeep, and reasonable content changes — things like updating photos, prices, services, contact details, and adding reviews. "Reasonable" means the sort of changes that take us minutes, not a redesign or a second website; if you ask for something bigger, we'll quote it separately before doing anything. Changes are usually made within 2 working days.

3. Payment

The build fee is payable up front (or, where we've agreed a pay-on-live arrangement, before the site is connected to your domain). The care plan is billed monthly by card via Stripe, starting when your site goes live. If a monthly payment fails and isn't fixed within 14 days of us letting you know, we may take the site offline until it's resolved.

4. Cancelling

You can cancel the care plan at any time with effect from the end of the billing month you've paid for. No notice period, no exit fee. When you cancel, the site comes down, because the care plan is what keeps it hosted.

5. What's yours and what's ours

Your domain name is registered in your name and is yours — if you leave, we'll assist with transferring it to you at no charge. Your content (your business details, photos you've supplied, your reviews, and the text on your site) is yours to take with you as text and images. The underlying code, templates, and systems the site is built with are ours and stay with us. You confirm that any content you send us (especially photos) is yours to use or you have permission to use it.

6. Your responsibilities

Keep your business details with us accurate; tell us when things change. Make sure your site content is truthful (e.g. accreditations like Gas Safe registration must be genuine and current — we'll include registration numbers you supply but can't verify them).

7. What we don't promise

We don't guarantee search engine rankings, volumes of enquiries, or any amount of new business. We build and maintain your site properly and set it up the way search engines like — outcomes depend on factors outside our control. We aim for the site to be online continuously but, like all websites, occasional downtime (e.g. hosting provider maintenance) can occur; we're not liable for losses arising from it.

8. Liability

Nothing in these terms limits liability that can't legally be limited. Otherwise, our total liability to you in any 12-month period is capped at the amount you've paid us in that period, and we're not liable for indirect losses such as lost profits or lost business opportunities.

9. Ending things from our side

We can end the care plan by giving you one month's notice (we'd only do this if we stopped operating or the relationship broke down), in which case we'll assist with transferring your domain and content out.

10. General

These terms are governed by the law of England and Wales. If we make material changes to them, we'll tell you by email or WhatsApp at least a month before they take effect. Our privacy notice explains how we handle your data.
